This End-User License Agreement ("EULA") is an agreement between you ("User" or "you") and Lukas Oberbeck, the developer of Event Bingo ("we", "us", or "our"), governing your use of the mobile application ("App") and the optional sponsoring offered within it. By using the App you agree to be bound by this EULA.
1.1 License: We grant you a personal, non-exclusive, non-transferable, limited, and revocable license to use the App on compatible devices owned or controlled by you, solely for your personal, non-commercial use, subject to this EULA.
2.1 What counts as your content: Everything you enter into the App — game names and descriptions, bingo squares, comments, your display name, feedback — is your content. You keep whatever rights you have in it.
2.2 License to us: You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use your content in any way and for any purpose, including to store, copy, modify, adapt, translate, publish, display, distribute, combine with other content and create derivative works from it, in any form and by any means, without any obligation to credit or compensate you. This license survives the deletion of your content or account and the termination of this EULA. How the App handles your content in practice, and who can see a game, is described in the Privacy Policy.
2.3 Sharing: You are responsible for whom you share a game's link with and for what you put into a game.
2.4 Your responsibility: You are responsible for your content. Do not enter content that is unlawful, offensive, or infringes the rights of others, and do not enter information about other people without their agreement. We are not obliged to monitor content, but we may remove content or games and suspend accounts that violate this EULA.
3.1 Voluntary: The App is free to use. Sponsoring — an optional, recurring subscription purchased through Apple's App Store or Google Play — supports the App's development and running costs. It unlocks no features; it changes only a thank-you note in Settings.
3.2 No guarantee of improvements: Sponsoring contributes to maintenance and development but does not guarantee specific updates, features, improvements, or continued availability of the App.
3.3 Billing: Subscriptions are sold, billed, renewed and cancelled through the store you bought them in, under the store's terms. The price is shown in the store at the time of purchase. The subscription renews automatically until you cancel it in your store account settings.
3.4 Refunds: Refunds are handled by the store under its policies and applicable law; we cannot issue refunds ourselves.
4.1 Prohibited activities: You agree not to use the App for any purpose that is unlawful or prohibited by
this EULA, including:
- Interfering with or disrupting the App, its backend, or third-party services it relies on.
- Attempting to gain unauthorized access to any part of the App, its backend, or other users' data.
- Using the App to infringe on the intellectual property or privacy rights of others.
- Distributing viruses or any other harmful code through the App.
- Automated or bulk use of the App's backend outside the App.
5.1 Ownership: The App, including its design, artwork, sounds, features, and software, is owned by the developer and protected by copyright, trademark, and other intellectual property laws. This does not apply to your content (section 2).
5.2 Restrictions: You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell the App or any part of it. Sharing game links, invitation texts and card screenshots created by the App's own sharing features is of course allowed.
We may modify this EULA. The current version is available from within the App; the date at the top shows when it last changed. Your continued use of the App after a change constitutes acceptance of the revised terms. If you do not agree, stop using the App; you can delete your account and data in the App at any time.
You can end this agreement at any time by deleting your account in the App and removing the App from your devices. We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases. Any sponsoring subscription is governed by the store's terms; cancel it in your store account settings if you no longer wish to be charged.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data will not be lost.
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the App; (ii) any unauthorized access to or use of our backend or any data stored therein; (iii) any interruption or cessation of the App or its backend; (iv) content entered by other users. Liability for intent, gross negligence, and injury to life, body, or health, and liability under mandatory law, remains unaffected.
This EULA and any disputes arising out of or related to it are governed by the laws of Germany, without regard to its conflict of law principles. Mandatory consumer protection rules of your country of residence remain unaffected.
By using the App, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to these terms, do not use the App.
